Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of GiveawayOK ("Service"), a platform for running Instagram giveaways operated by the GiveawayOK team ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

Our Service is provided to help Instagram creators easily manage their giveaways. We focus on supporting Ukrainian users, while we are happy to welcome creators from around the world, except from the aggressor country, the russian federation, to join our platform.

2. Description of Service

GiveawayOK is a service that allows users to run Instagram giveaways using the official Meta API. The Service provides the following functionality:

Connection to an Instagram professional account
Selection of an Instagram post or reel
Configuration of giveaway rules
Processing of giveaway data
Random selection of winners

2.1 No Relation to Contests

In accordance with the current legislation of Ukraine, GiveawayOK as a technical service has no relation to the organization, conduct, administration, or management of contests, giveaways, or other promotional events. We provide only a technical tool for data processing and random selection of winners. All responsibility for organizing, conducting, compliance with contest rules, determining winners, providing prizes, and compliance with all applicable laws and regulations lies entirely with the user who organizes the contest. We are not an organizer, sponsor, or participant of any contests and are not responsible for their conduct or results.

3. Account Registration and Requirements

3.1 Instagram Professional Account

To use our Service, you must have a valid Instagram professional account. You are responsible for ensuring that your use of the Instagram professional account complies with Instagram's terms of service and other applicable policies.

3.2 Account Information

You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date.

3.3 Geographic Considerations

While our Service is available globally, certain features may be optimized for Ukrainian users. We strive to provide equal quality service to all users regardless of location.

4. User Responsibilities

4.1 Compliance with Laws and Regulations

You are responsible for ensuring that your giveaways comply with all applicable laws, regulations, and rules in your jurisdiction and the jurisdictions of your participants, including but not limited to laws relating to promotions, sweepstakes, and lotteries.

Special consideration for Ukrainian users: Please ensure compliance with Ukrainian laws regarding promotions and contests.

4.2 Instagram Rules

You must comply with Instagram's terms of service, community guidelines, and promotion guidelines. We are not responsible for any violations of Instagram's policies resulting from your use of our Service.

4.3 Responsible Use

You agree to use our Service in a manner that:

Does not harm others or our Service
Respects the rights and privacy of other users
Promotes positive engagement and community building

5. Service Provision and Use

5.1 Electronic Service Provision

The service purchased by the user is provided in electronic form. The service becomes available to the user after successful completion of payment for the subscription period or according to the terms of the selected pricing plan.

5.2 Agreement to Terms upon Payment and Effective Date

By making payment for services, the user confirms their full and unconditional agreement with these Terms of Service, Privacy Policy, and Refund Policy. Payment for the service means the user's acceptance of all terms and their immediate entry into force from the moment of payment confirmation and access to the service.

In accordance with Article 13 of the Law of Ukraine "On Consumer Rights Protection" and Article 9 of the Law of Ukraine "On Digital Content and Digital Services", the provision of digital content and digital services that are not provided on a tangible medium begins immediately after payment confirmation. By making payment, the user gives explicit consent to the start of service performance before the expiration of the withdrawal period and confirms that they understand that they will lose the right of withdrawal after the start of service performance.

5.3 Access to Services

After successful payment, the user receives access to services according to the selected pricing plan. The user undertakes to use the service in accordance with the current laws and regulations of Ukraine. The user is responsible for any illegal use of the service.

5.4 Usage Restrictions

The user acknowledges, declares, and undertakes not to use GiveawayOK services, which are licensed in accordance with the Law of Ukraine "On Copyright and Related Rights", for commercial purposes or transfer them to third parties, and that the user is not granted rights that are not explicitly stated in this agreement.

6. Cancellation and Refund Policy

6.1 Digital Content and Services

Purchased services are considered digital content in accordance with the current legislation of Ukraine on consumer rights protection, including the Law of Ukraine "On Consumer Rights Protection" and the Law of Ukraine "On Digital Content and Digital Services".

6.2 Right of Withdrawal

In accordance with the legislation of Ukraine on consumer rights protection, consumers have the right to withdraw from a distance selling contract within 14 days from the date of receipt of the goods or conclusion of the service provision contract without stating a reason. The seller is obliged to return the paid funds within 14 days from the date of receipt of the withdrawal notice.

6.3 Exceptions to the Right of Withdrawal and Waiver of Refund Right

In accordance with Article 13 of the Law of Ukraine "On Consumer Rights Protection" and Article 9 of the Law of Ukraine "On Digital Content and Digital Services", for digital content and services that are not provided on a tangible medium, the right of withdrawal may be lost if:

The user has given prior explicit consent to the start of service performance before the expiration of the withdrawal period
The user has confirmed that they understand that they will lose the right of withdrawal after the start of service performance
Service provision has already begun

By making payment, the user explicitly and knowingly agrees to the immediate start of service provision after payment confirmation and waives the right to a refund in case the service is provided properly and corresponds to the description.

After the start of service provision, refunds under the right of withdrawal are not made if the service is provided properly.

6.4 Defective or Incomplete Service Provision

In case of defective or incomplete service provision, the user may contact us to request problem resolution. We undertake to provide appropriate resolution or refund funds in case of impossibility to provide the service properly.

6.5 One-Time Purchases

For one-time purchases (purchase of a link), after service activation and access provision, refunds are not made if the service is provided properly.

7. Subscription Updates and Cancellation

7.1 Automatic Renewal

Subscriptions automatically renew at the end of each term (monthly or annual), if the user does not cancel them, and the service continues until the end of the next term. The renewal fee is charged from the registered payment method.

7.2 Subscription Cancellation

If the user wishes to cancel the subscription, cancellation can be processed through the "My Account > Subscription" page. Cancellation will take effect at the end of the current subscription period. The user will retain access to all features until the end of the paid period.

7.3 Refunds for Subscriptions

In accordance with Article 9 of the Law of Ukraine "On Consumer Rights Protection" and the Regulation on Distance Selling, the user cannot exercise the right of withdrawal for subscription periods that are already determined and activated. In accordance with this provision, refunds are not made for subscription periods that are already activated and provided.

If the user does not want the subscription to renew, they must cancel the subscription before the renewal date.

8. Data Usage and Privacy

8.1 Data Collection

We only collect the data necessary to provide the Service, including your Instagram account information and information about the selected post or reel.

8.2 No Data Selling

We do not sell your data to third parties. Your data is used solely for the purpose of providing the Service.

8.3 Privacy Policy

Our Privacy Policy, which is incorporated into these Terms by reference, provides additional information about our data practices.

8.4 Cross-Border Data Processing

As we serve users globally, your data may be processed across different countries in accordance with applicable data protection laws.

9. Intellectual Property

9.1 Our Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, and content, are owned by us or our licensors.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose in accordance with these Terms.

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Liability for Contests

IN ACCORDANCE WITH THE CURRENT LEGISLATION OF UKRAINE, WE ARE NOT LIABLE FOR THE ORGANIZATION, CONDUCT, ADMINISTRATION, OR MANAGEMENT OF ANY CONTESTS, GIVEAWAYS, OR OTHER PROMOTIONAL EVENTS. WE ARE NOT AN ORGANIZER, SPONSOR, OR PARTICIPANT OF ANY CONTESTS. ALL RESPONSIBILITY FOR CONTESTS, THEIR RULES, DETERMINING WINNERS, PROVIDING PRIZES, AND COMPLIANCE WITH LEGISLATION LIES ENTIRELY WITH THE USER WHO ORGANIZES THE CONTEST.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE.

11. Changes to Terms

We may modify these Terms from time to time. If we make changes, we will provide notice of such changes as appropriate, such as by posting the revised Terms on our website with a new "Last Updated" date at the bottom of the page. Your continued use of the Service following the effective date of any changes to these Terms constitutes your acceptance of those changes.
